What is a "Reasonable Number of Attempts"?
California law doesn't define a specific number in all situations, but general guidelines are used. These can include two or more attempts to repair a defect that could cause death or serious injury. Four or more attempts to repair the same substantial defect may also qualify. If the vehicle has been out of service for more than 30 days (not necessarily consecutive) for repairs during the warranty period, it may also be considered a lemon.
Your Rights Under the California Lemon Law
If your vehicle qualifies as a lemon, you have several rights. You may be entitled to a repurchase, where the manufacturer must buy back the vehicle, refunding the purchase price, taxes, registration fees, and other expenses (minus a deduction for the use of the vehicle before the first repair attempt).
Alternatively, you may be entitled to a replacement, where the manufacturer must provide a comparable new vehicle. You may also be able to recover incidental and consequential damages, including expenses such as towing charges, rental car costs, and even attorney's fees. Civil penalties can also apply, increasing your recovery.
